As far back as August 2015, Trump proposed ending birthright citizenship. No action during his first term. Eleven years later, five justices deemed his executive order violated the 14th Amendment.
During this time, the Republicans in the Senate and the House sat on their hands.
The Executive Order was straightforward and measured in its intent to exclude children born to temporary or illegal aliens from birthright citizenship.
Republicans in Congress should have immediately pushed to codify the executive order into legislation. Doing so would have forced the Senate (or in Mark's words, "the citadel of crap") into debating why it is or is not in the best interests of the current citizens of the USA to grant citizenship to children of parents who break the law to enter the country or for birth tourism.
As is their practice, or lack thereof, the Republicans did nothing.
So, Trump is floating a yet unknown legislative action to address the issue. Five justices have already invoked the 14th Amendment to justify birthright citizenship to children born to illegal aliens with 14th Amendment. Good luck with that.
Of course Republican leaders aghast by the ruling have stated they will have to study next steps. What's to study? Tomorrow, draft the language of the executive order as written into a proposed amendment to the Constitution and run with it. Let the chips fall where they may.
P.S. Canada is one of the few other countries that also grants nearly unrestricted birthright citizenship. Is there any push in Canada to change this?
